Del Mar will soon have more flexible zoning for lot splits and multiple units based on state law. Senate Bill 9(SB9) enables staff approval without public hearings for significant increases in what is allowed to be built on single dwelling lots.

 

However, Del Mar, along with many other cities has developed an implementing ordinance which calls for limitations on height, size, setbacks, parking, and objective design standards. This ordinance has been approved by the Coastal Commission with a few modifications. The city must adopt this ordinance to remain compliant with the State certified Local Coastal Program.

 

SB9 is one of many state laws enacted by the state Legislature to address California’s housing crisis. Developers are permitted to either subdivide a lot into two parcels which would enable two structures on each side for a total of four where only one is now allowed. Del Mar’s ordinance will require one of the units in a SB9 project to be deed restricted for affordable rent for 55 years.

 

Realtor sources do not believe there will be much demand for SB9 projects in Del Mar because of the high demand for high-priced single family residences.
